Terms and Conditions

1. Acceptance of Terms

By creating an account on KudoBits ("the Service"), you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Service.

If you are signing up on behalf of a child under the age of 13, you confirm that you are a parent or legal guardian and you consent to these terms on their behalf.

2. Description of Service

KudoBits is a family management platform that allows parents and guardians ("Adults") to set tasks, award kudos points, and manage a virtual reward store for children ("Kids") within their family group.

The Service includes messaging, notifications, friend connections, and profile management features.

3. Eligibility and Account Registration

To use KudoBits you must:

  • Be at least 18 years old to register as an Adult account.
  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and account credentials.
  • Notify us immediately of any unauthorised use of your account.

Kid accounts are intended for users under the age of 18 and may only be created by an Adult within a family group. Adults are responsible for all activity on Kid accounts they manage.

Access to the Service may require a valid signup code issued by KudoBits. Signup codes are non-transferable and may be revoked at our discretion.

4. User Conduct

You agree not to use the Service to:

  • Post or transmit content that is harmful, offensive, abusive, or unlawful.
  • Harass, threaten, or intimidate any other user.
  • Impersonate any person or entity.
  • Attempt to gain unauthorised access to any part of the Service.
  • Use the Service for commercial purposes without our written consent.
  • Scrape, crawl, or otherwise extract data from the Service by automated means.
  • Use any part of the Service to train artificial intelligence or machine learning models.

5. Privacy and Children's Data

We take the privacy of children seriously. Kid accounts may only be created by a verified Adult within a family group. We collect only the minimum information necessary to provide the Service.

We do not sell, rent, or share personal data with third parties for marketing purposes. Please refer to our Privacy Policy for full details on data collection and use.

Adults may delete their family's data at any time by contacting us or using the account deletion feature in Settings.

6. Messaging and Friend Connections

The messaging feature allows users to communicate within the platform. Adults control friend connections and messaging permissions for Kid accounts they manage.

By using the messaging feature you agree not to send spam, unsolicited messages, or any content that violates these Terms.

We reserve the right to review and remove content that violates these Terms, and to suspend or terminate accounts that misuse the messaging feature.

7. Virtual Currency and Rewards

KudoBits uses a virtual currency system ("Bits") for the purpose of rewarding children within a family group. Bits have no real-world monetary value, cannot be transferred outside the platform, and cannot be exchanged for real money or goods.

We reserve the right to modify, suspend, or discontinue the virtual currency system at any time.

8. Intellectual Property

All content, branding, and software on KudoBits is owned by or licensed to KudoBits and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our express written permission.

9. Account Suspension and Termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we determine that your use of the Service is harmful to other users or to KudoBits.

You may close your account at any time from the Settings page. Upon closing your Adult account:

  • Any Kid accounts you manage that have no other Adult in their family group will also be deactivated. Their data will be deleted in accordance with our Privacy Policy.
  • If another Adult exists in the family group, management of that family will transfer to them.
  • Virtual Bits balances and reward history will be permanently deleted and cannot be recovered.

Sections 8, 10, 11, and 12 of these Terms survive termination.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, KudoBits shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, the Service.

12. Modifications to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

13. Dispute Resolution

If you have a dispute with us, please contact us first via the Support page. We will make every effort to resolve the issue informally within 30 days before any formal legal proceedings are initiated.

These Terms are governed by and construed in accordance with the laws of New Zealand. If a dispute cannot be resolved informally, it shall be subject to the exclusive jurisdiction of the courts of New Zealand.
